Terms and Conditions
Payment can be made by bank transfer or cheque, details of which are on the booking form and will be sent in your invoice over email.
A deposit of £300 per bike is required if you reserve your place more than 24 weeks before the tour starts. 50% of the tour price is required to be paid 24 weeks before the tour starts and the total balance must be paid 12 weeks before the tour starts. To ensure proper account crediting, please include your booking reference number on bank transfers.
RELEASE AND WAIVER
All final balances must be paid 12 weeks prior to the tour start date. If the total balance is not received 12 weeks before the tour start date, Ride Nepal reserves the right to treat this reservation as cancelled and charge the cancellation fee which is the full cost of the tour.*
Every participant in a Ride Nepal Tour is required to accept and sign Ride Nepal Terms and Conditions before the guided tour begins. Ride Nepal cannot accept any tour participant without the above.
Rental motorcycles are included as part of the tour package. Either Honda CRF250L, Reiju marathon pro 200, Suzuki DR 200, Royal Enfield Himalayan 400, Royal Enfield Bullet 350, BMW F800 GS, BMW R1200 R or BMW R1200 Adventure motorcycle models will be reserved on a first come first serve basis, as there are limited numbers of each models. Ride Nepal reserves the right to substitute the motorcycle requested by tour participants. Unfortunately, at times, certain unexpected and uncontrollable situations arise which may require the substitution of a motorcycle. This includes, but is not limited to, delay in manufacture or fleet delivery, mechanical failure, collision damage and theft. Should Ride Nepal not be able to provide the confirmed motorcycle, another model will be provided to the Client.
The client is responsible for the motorcycle throughout the tour and if the motorcycle acquires any damages then the expenses of repair will be charged to the client on top of the tour cost. The agreement between Ride Nepal and the client is also consistent with the following points.
- Care of Equipment. Equipment can only be used in a careful and proper manner and shall not be used in any way that is inconsistent with Ride Nepal’s instructions or owner manuals.
- Repair and Alterations. The costs of any damages outside of normal wear and tear incurred during the Term shall be paid by the Client, including but not limited to labour, material, parts and other items. Equipment shall not be serviced or repaired and parts and accessories shall not be replaced without Ride Nepal’s prior consent.
- Indemnification and Liability. The Client shall indemnify, defend and hold harmless Ride Nepal from and against any claim, demand, cause of action, loss or liability (including attorney’s fees and expenses of litigation) for any property damage or personal injury arising from Client’s use of Equipment by any cause, except to the extent caused by Ride Nepal’s gross negligence or willful misconduct. The provisions of this Article shall survive the termination of this Agreement with respect to any claims or liability accruing before such termination.
- Restrictions on Use. Client shall not: a) permit the Equipment to be used by any person who is not authorized to use such Equipment; b) operate or use the Equipment or permit it to be operated or used in violation of law; c) operate or use the Equipment or permit it to be operated or used to commit a violation of law; and/or d) operate, use, maintain or store the Equipment in a manner likely to cause damage to the Equipment.
- Renter must carry his own insurance satisfactory to Ride Nepal, that covers them to ride the appropriate engine size motorbikes in Nepal on and off road.
- In case of accidents involving a third party that results in damages of the third party property, equipment or person, the renter would also be liable for these expenses including but not limited to: equipment repairs, medical expenses and compensation. Ride Nepal advises the Client to take out adequate personal liability insurance that will cover the Client and third parties.
PRICE OF TOUR INCLUDES
The items included in the tour price are listed below:
- Motorcycle Hire
- Accommodations based on double occupancy unless the Single Room supplement is chosen
- All meals; breakfast, lunch & dinner, (day of arrival; breakfast & lunch are not included, day of departure; lunch & dinner are not included) afternoon snacks, soft beverages, tea and coffee
- English speaking Guides
- Support Vehicle (if more than 4 riders)
- Unlimited Mileage
- All Transfers
- Any permit fees for national park entry
NOT INCLUDED IN OUR TOURS
- Personal insurance, including trip cancellation insurance, and helicopter rescue and repatriation.
- Personal expenses; tips for guides, souvenirs, laundry.
- Alcoholic beverages, on the day of arrival breakfast and lunch are not included and on the day of departure lunch and dinner are not included.
- Any other expenses not listed in the included in the price section.
The tour price includes hotel accommodation in double or twin rooms. Depending on which part of Nepal we are in, the more remote areas have only basic hotels available which means a squat toilet and cold water bucket showers. Where Basic Hotel, Teahouse or Lodge is written in the itinerary this may apply. In some trips camping is part of the experience, please see detailed itinerary to see whether this applies to your trip. All camping equipment; tents, sleeping mats, sleeping bags, dining tent and toilet tent will be provided. Showering may be limited to a bowl of hot water in the evening and morning. And the toilet facility while camping will be a hole dug in the ground, a tent for privacy and the option of a seat to sit on if you are not comfortable squatting. Hotel check in times for Kathmandu are earliest 1pm and check out time is latest 11am. If your time of arrival or departure from Kathmandu clashes with either of these times, either you arrive earlier than hotel check in or leave later than hotel check out, please inform us and we can arrange accommodation at an extra cost.
Ride Nepal assumes no responsibility for loss, damage when your baggage is left in the hotel’s storage facility or in the Ride Nepal office, please make sure the bags are securely locked. Baggage insurance is recommended.
We try not to cancel any of our tours to ensure our customers are satisfied with our service and trust in our company and will book with us again. Situations may arise which make it necessary for us to cancel, advance or postpone a scheduled tour, change itineraries or make substitutions regarding hotels, cities, tour guides and other travel arrangements. If there are any such changes we will notify the clients as soon as possible. We start planning the motorcycle tours we offer many months in advance. Occasionally, we have to make changes to and correct errors in itineraries and other details both before and after bookings have been confirmed and very rarely cancel confirmed bookings. Whilst we always endeavor to avoid changes and cancellations, we must reserve the right to do so. However, we will have to cancel your confirmed booking if you fail to comply with any requirement of these booking conditions, such as not paying on time, unacceptably abusive behavior or where we are forced to do so as a result of ‘force majeure’ as defined below.
Except as set out in these terms and conditions, we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected, or you otherwise suffer any loss or damage as a result of circumstances amounting to ‘force majeure’. In these terms and conditions ‘force majeure’ means any event or circumstances which we or the supplier of the services in question could not foresee or avoid even with due care. Such events and circumstances may include, whether actual or threatened, war, insurrection, riots, strikes, civil action, decisions by governments or governing authority, technical or maintenance problems with transport, changes of schedules or operational decisions of air carriers, terrorist activity, industrial action, natural or nuclear activity, epidemics/pandemics, adverse weather conditions, fire and all similar events outside our control.
*CANCELLATION AND REFUNDS
Cancellations received more than 60 days prior to departure will be subject to a £300 cancellation fee per person. Cancellations received less than 60 days prior to departure will be subject to the following forfeit of tour cost:
60 – 31 Day Cancellation Notice: 60% of Tour cost
30 or Less Day Cancellation Notice:100% of Tour cost
No Show:100% of Tour cost
Exceptions to this policy cannot be made for any reason. Trip cancellation insurance is recommended.
If you decide to spend extra nights before or after the tour Ride Nepal will be happy to book those additional nights for you. We will advise you of the additional costs for each hotel. If you cancel additional nights accommodation the following fees will apply:
60 – 31 Day Cancellation Notice: 60% of Total Booking Amount
30 or Less Day Cancellation Notice: 100% of Total Booking Amount No Show:100% of Total Booking Amount
Please bring any complaints to your tour guides immediate attention. Do not wait until the tour is over; we take customer complaints very seriously and will try to resolve problems immediately.
NON-OBSERVANCE OF TRAFFIC LAWS AND GROUP TRAVEL REQUIREMENTS
If the customer does not comply with traffic laws or the requirements for group travel, which are to ride safely, responsibly and with due care and regard for other people and property, Ride Nepal may cancel the contract and the customer will no longer be able to ride the rental motorcycle.
- 21 years of age or older
- Valid A2 or A motorcycle license (or equivalent in other countries)
TRAVEL REQUIREMENTS AND RECOMMENDATIONS
Visitors to Nepal must have a passport valid for at least 6 months when you submit your application for a visa. Getting a visa upon arrival at Tribhuvan Kathmandu International Airport is the most common way for obtaining a visa when entering Nepal. You must carry cash with you in an accepted currency to pay for your visa. Taking a few passport photos with you is recommended for your stay in Nepal. We recommend each of our clients to visit their local GP or travel clinic to get up to date advice on vaccinations for Nepal.
Bookings are accepted on the understanding that clients appreciate and accept the possible risks inherent in on and off-road motorcycle travel and that they undertake the tours in our programme at their own volition.
Ride Nepal will not be held liable for any accidents. It is your responsibility to listen to your tour leader and follow his or her instructions or advice. In case of any incident of harm, injury or even death Ride Nepal will not be held responsible.
It is vital that you have appropriate travel insurance, which offers cover while motorcycling. Ride Nepal and its Agents, accept no responsibility for a customer’s failure to arrange appropriate cover. Please also note that cover is often void if a helmet is not being worn. We strongly recommend you cover yourself with travel insurance in case of accident and to ensure that if your personal circumstances change and you have to cancel, your costs are covered.
By booking a rental motorbike, self guided tour or guided tour you agree that you understand and agree to the indemnity release detailed below which is between you (and any passengers) and Ride Nepal, it’s directors, employees or agents (hereafter called The Company).
You must agree that you shall participate entirely at your own risk and that you, your successors, executors and administrators will release, indemnify and not instigate any claim, demand or expense against The Company for any personal injury, loss of life or damage to personal property suffered during or subsequent to events on the rental or tour.
You must acknowledge that any road whether paved or unpaved, or any other venue upon which you travel, may have sandy or rocky surfaces with defects either hidden or exposed as is the nature of some roads. You must agree to obey and observe all rules and directions given during a tour, whether given in writing or verbally by The Company and that The Company has the right to exclude you from any tour for non-adherence to any rule or direction given.
You must accept that you are permitted to rent a motorcycle or take part in a tour on condition that you ride safely with due care and regard for other people and property.
You must acknowledge that motorcycle riding, whether as a rider or passenger, can be dangerous and that a motorcycle rental or participation in a tour organised and promoted by The Company may expose you to the possibility of injury or death and further, you must acknowledge that the way other people may ride, drive or act is outside the control of The Company.
You must acknowledge that there may be no, or inadequate facilities for treatment or transport of participants if participants are injured. You agree that you understand that travel insurance to cover all forms of personal injury, repatriation or costs in the event of death is essential and it is your responsibility to ensure you have appropriate cover.
You agree to wear appropriate motorcycle safety equipment at all times and that you are medically fit to undertake a motorcycle rental or tour.
You must agree that you have read and understood the indemnity release and agree that the motorcycle rental or participation in a tour whether guided or self guided is entirely at your own risk.
During any excursions during the tour operated by independent suppliers Ride Nepal are not responsible for any failure or negligence on the suppliers part. Ride Nepal aim to keep you safe and secure during the tour and only use suppliers whom Ride Nepal know and trust. Ride Nepal does their best to provide you with safe and enjoyable experiences as far as Ride Nepal can, but once Ride Nepal hand you over to the independent suppliers hands then Ride Nepal cannot be held responsible for any instance of injury or harm to you during this time. Excursions include any which are run by independent suppliers, including but not limited to: Elephant Back Safari, Jungle Walk, Bungee Jumping, Paragliding, White Water Rafting etc.
Every effort will be made by your tour guide to provide you with a stress-free holiday. Please listen carefully to your guides instructions at the beginning of the tour. Your guide will and has to adjust to the weakest rider in your group. It is impossible to meet everyones needs and wishes, however you may be given the opportunity to gain as much independence on your tour as possible if you simply speak to your tour guide about your wishes.
ALTERATIONS TO TOUR SCHEDULE
Tours operate on a seasonal basis and where seasonal variances and/or weather conditions cause changes in the tour routing and accommodations, the itinerary will be adjusted accordingly and alternate hotels, restaurants and roads will be used.
Ride Nepal strives to schedule its tours at a time of the year, when the weather in the touring area is usually pleasant for motorcycling. Many tours pass through areas where weather conditions can change very fast and significantly. Ride Nepal cannot be made liable for unpleasant and unsuitable weather conditions and no refunds are made for such conditions.
Ride Nepal recommends that you take out adequate personal travel insurance including helicopter rescue and repatriation, as well as trip cancellation insurance. We will request information about your Travel Insurance Company and whom we should contact in an emergency. Please also do inform your tour leader of any health issues that you feel they should be aware of.
Every client will receive a full orientation to the motorcycle. The client orientation will cover aspects of safe motorcycle operation, the clients maintenance responsibilities and general rules of the road. Information on riding style in Nepal is included in the tour information pack.
Clients must bring their own helmets, gloves, jackets, trousers, sufficient body armour, motorcycle boots, rain gear etc. for comfort and style reasons. Helmets must be worn at all times.
The hotel in Kathmandu will provide storage for client luggage, free of charge, however at the clients risk.
Fuel costs are included for the duration of the selected tour.
The customer is responsible for reporting mechanical failures immediately. Customers may be held responsible for mechanical damage due to negligence in motorcycle operation.
TOURING ON YOUR OWN MOTORCYCLE
You are responsible for your own motorcycle, insurances, maintenance, breakdown and any pillion passengers.
Ride Nepal does not intentionally use any copyrighted materials on the website. In the event of Ride Nepal unintentional use of any copyrighted material, whether it be images, wording or music on Ride Nepal website, or anything else connected with Ride Nepal, we reserve the right to remove the said mentioned without fine, fee or any other costs from any of the copyright holders, companies acting on behalf of copyright holders, or their subsidiaries.
I irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms and Conditions or its subject matter of formation (including non-contractual disputes or claims).
